Your Gold requires all visitors to the Site adhere to the following Terms and Conditions. By accessing the Site and any of its pages, you indicate your acknowledgement and acceptance of the Terms and Conditions set forth below without limitation or qualification. Your Gold may revise these Terms and Conditions at any time by updating this posting, which revisions will be binding upon all visitors to the Site. You should therefore visit this posting to review these Terms and Conditions from time to time as you visit the Site. For purposes of these Terms and Conditions references to Your Gold include its affiliates, directors and employees. Requirements for Use
All customers who send in their items to us must be a minimum of twenty-one (21) years of age to participate in the transaction of selling gold, silver, platinum, diamonds or any other precious metal or stones to YourGold. To participate in any transaction including payout for your jewelry, one must be the legal owner of the items presented to YourGold, All participants must act for themselves and not represent any other person or entity in the transaction and payout for the items submitted. YourGold reserves the right to investigate and ask for documents that may or may not warrant the refusal of business to any individual or entity at YourGold discretion. Request of YourGold materials and the act of sending in your items to YourGold, constitutes that the client is agreeing to all conditions, terms and policies of YourGold as described on its website.
Guaranty Against Loss
Items that are shipped accurately to YourGold will be guaranteed against the loss of the content, defined by YourGold and it’s website YourGold.com. YourGold reserves the right, in its sole discretion, to not accept any package, envelope, or jewelry that it deems unaccepted. Packages that are tampered with, damaged or destroyed in the process of delivery will not and shall not be the responsibility of YourGold. Packages that fit the decription of the terms above will be declined by YourGold with no liability assumed to YourGold. Participating members who have concerns for the safety and value of their items must choose to ship or send their items by means of there choosing at no liability to YourGold. YourGold assumes no liability for the return of items to any participant or member who sends us goods that are damaged due to shipping.
Limitation of Liability
The liability to any and all individuals, members, insurance carriers, or any third party who claim or holds claim or action to any transaction with or against YourGold for loss, damage or destroyed merchandise shall not exceed $100.00 per transaction. You agree that YourGold will not be liable for punitive, incidental, indirect damages or loss of opportunity or profit. Individuals, participants and members waive the rights and claims of insurance carriers towards YourGold LLC. YourGold will not be liable for actions taken by any subrogation claim brought by your insurance carrier. In sending us any package, you waive the subrogation claim on your behalf as well as that of the insurance carrier.
The liability that YourGold shall incur is limited to the lesser of the following:
1. The value of the items sent to YourGold in total, appraised and valued at YourGold’s sole discretion.
2. The sum of One Hundred ($100.00) Dollars.
3. The submittal of a valid appraisal prior to the submission of your items to YourGold. YourGold shall not be liable for more than (25%) twenty five percent of that appraisal(not to exceed $100.00)one hundred dollars. In no situation or circumstance shall YourGold exceed One Hundred ($100.00) Dollar total payout(limited to $100.00 for any package receive using proper shipping methods) of liability to individuals, company, or insurer.
The submission of items to YourGold, customers except all terms and condition and the limitation of liability. YourGold shall not be liable for punitive, incidental or loss of profit by any person or company that submits their items to YourGold.
YourGold will provide any valid customer (deemed to be valid by YourGold) a free Your Gold Pack. In this pack participating members will receive a pre-paid postage envelope. YourGold insures the use of this pack for a maximum of $100.00(one hundred dollars)
If you for any reason feel that your items have a value of more $100.00(one hundred dollars) you will need to use a carrier of your choice that allows you to insure the pack for your estimated value of your items. YourGold waives all responsibility of shipping of these items.
Payments are issued within 24 hours of the receipt of the package by YourGold. YourGold offers a Ten(10) day gold back guarantee for all customers who are paid via check. This time period begins from the date on the check. All payments and checks must be returned to YourGold prior to the release of any items. Items being returned can take up to thirty(30) days to be returned. If a customer chooses the option of direct deposit, the 10(ten) day guarantee is voided. The 10 day guarantee is also voided when a customer cashes their payment check. YourGold assumes no liability past the points stated above.
The time limitation above can not be changed or altered by any individual, member or employee of YourGold LLC.
120% Guarantee
YourGold will match any reputable nationwide gold buying company quote when it is submitted to YourGold with your gold for sale. The quote given to YourGold must be on their companies stationary, and be itemized to correlate with the items you send in. In the case that we give you a lower written quote for your gold, you will receive from YourGold an instant price match for your gold plus 20% of the quote from any reputable nationwide gold buying company. 100% of the payout will cover the purchase of your gold at our competitors written quoted prices. YourGold will also pay you 20% of that total up to a maximum payout of $100.00 (one hundred dollars) Our 120% guaranteed price match is the industries best. All terms and conditions, are set and may not be changed to accommodate individual customers. The maximum payout will never exceed 20% or $100.00(one hundred dollars) whichever limit is met first.
Insurance Liabilities on Return Item
YourGold will only insure items being returned to customers for the YourGold appraisal value of the items. Sending in your items to YourGold waives YourGold of the responsibility of any returned item for the customer’s perceived value of this or any item submitted to YourGold. YourGold is limited to the liability of its own appraisal value of any item at its own discretion.
Submitting a Claim
A customer who wishes to submit a claim to YourGold must NOTIFY THE COMPANY
IMMEDIATELY TO REQUEST A CLAIM FORM. In order to be processed, the claim
form must be fully and accurately completed, signed and mailed to YourGold LLC
in accordance with the claim form instructions. The customer must submit
any and all supporting documentation with the completed and signed claim
form. Failure to properly complete, sign and/or mail the claim form WITH
PROOF THAT THE GOODS WERE MAILED TO YOURGOLD will result in the denial of the
claim by YourGold. There is a 30 day waiting period from the time the
claim form is received by YourGold and the claim is processed.
Choice of Law, Waiver, and Claims
These terms and conditions, and all YourGold transactions, will be governed by the laws of the State of Illinois without regard to its conflict of law provisions. YourGold's failure to exercise or enforce any right or provision of these terms and conditions will not be deemed to be a waiver of such right or provision. If any of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other terms and conditions will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the YourGold or otherwise with YourGold must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the State of Illinois. YourGold will be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in any jurisdiction outside of the State of Illinois, including but not limited to, attorney’s fees incurred by YourGold.
